HBT: Balentien in trouble for in-game tweeting

Former Mariner and Red Wladimir Balentien has 12 homers in only 45 games for the Yakult Swallows. But after a fast start that gave him those power numbers, he has slumped, going homerless in 50 straight at bats and seeing his average drop over a 100 points.

So he tweeted about it, the other night. He just picked a bad time to do it:

Former major league baseballer Wladimir Balentien has been warned by his Japanese team the Yakult Swallows for updating his twitter account during a 10-0 loss.

Balentien, who has been in the midst of a prolonged slump, tweeted ?I will never give up? just before the end of Monday?s 10-0 loss to the Seibu Lions. He was sent to Yakult?s minor league team on Tuesday.

It?s unclear if the demotion was due to the tweeting or the slumping. But either way, not the kind of thing that flies in the NPB I imagine.

Metal chunks fall from jet after engine failure

An Air Canada Boeing 777 airplane was forced to make an emergency landing shortly after takeoff from Toronto's Pearson International airport after debris fell from the plane. NBC's Tom Costello reports.

By Alastair Jamieson, msnbc.com

Chunks of metal the size of a cellphone fell onto cars in a neighborhood near Toronto airport Monday, around the same time as an Air Canada Boeing 777 made an emergency landing, CBC reported.

The airliner, bound for Japan, suffered a failure in one of its engines shortly after takeoff from Pearson International Airport.

The plane dumped fuel before returning to Pearson, landing normally using one engine. No injuries were reported.

The aircraft is thought to be fitted with GE90 engines. (GE is part-owner of NBC Universal, which is joint parent company of msnbc.com).

At least four vehicles were hit by pieces of metal, according to Peel regional police Constable George Tudos, but there was no immediate confirmation the debris was from the plane.

?We believe it is, but it's not up to us ? we're not the investigating body,? Tudos told CBC.

"As it [the plane] was traveling away from Pearson we had other complaints stating that debris, consisting of metal objects, was falling from the sky," he said.

On Twitter, residents near the intersection of Derry and Kennedy Roads in Mississauga were posting photos of a vehicle?s rear windshield that was apparently smashed by falling material from the plane, Canada's National Post reported.

CBC said there were 318 passengers and 16 crew aboard Flight AC001, which took off from Pearson at 2:10 p.m. ET and returned to make its emergency landing at 3:53 p.m. ET.

Air Canada spokesman Peter Fitzpatrick said the plane's crew requested the emergency landing shortly after takeoff.

A businessman who was on board the plane tweeted that passengers were told it was an engine overheating.

"Seems my plane fell apart! Luckily we managed to land it," Jason Flick tweeted, adding that the plane spent 20 minutes dropping fuel.

The passengers were given hotel accommodation overnight and were expected to resume their journey Tuesday.

The Associated Press contributed to this report.

Praciticing T'ai Chi and Other Internal Martial Arts Can Give a Boost ...

29/05/2012 Por: admin - En categor?a Sin categor?a

What westerners do for recreation, sport, or exercise has changed greatly in the last few decades. Even three decades ago, sitting cross-legged on the floor to meditate or doing slow and mindful Asian-Oriented movement was something that only the anti-establishment hippy types did. (Do you recall that kind of name-calling?) Today, the establishment is joining them in these less-traditional activities.

What?s interesting is the use of the terms ?less traditional? to describe T?ai Chi and Qigong. The Chinese and other Eastern cultures consider things like meditating or moving slowly in a park to be pretty darn traditional, but they?ve considered jumping around a room to disco music, taking your pulse, and running or walking around city streets for fitness to be pretty odd.

But times are changing. Westerners have become more tolerant, accepting, and open to Eastern practices, and Easterners have become the same of Western practices.

Each type of activity has its rewards.

Before learning how T?ai Chi can help you, we?ll go into a short summary of what T?ai is.

T?ai Chi, as it is practiced in western cultures, can perhaps best be thought of as a combination of yoga and meditation. There are a numerous forms called ?sets? which is a sequence of movements. Many of these movements are originated from martial arts, although the way they are performed in Tai Chi is slowly with graceful smooth movements and even transitions the movements.

The purpose of Tai Chi is to foster a calm and peaceful mind, focusing on precise execution of these movements. Learning to do them correctly provides better balance, alignment, motor skills, rhythm of movement, improves the movement from the body?s vital center. Thus practicing T?ai Chi can help you to stand, walk, move, and run. This will also help your own thought process and mental awareness in all spheres of your life. Many practitioners notice benefits in terms of correcting posture, alignment or movement patterns which can contribute to your likely hood of tension or injury. Lastly the meditative nature is calming and relaxing in and of itself. So if you are trying to find ways to reduce stress T?ai Chi is an excellent way to do so.

Praciticing T?ai Chi and other internal martial arts can give a boost to your health and your workout. To summarize.

1. You find out how to slow down instead of always going faster and harder.

2. You can capture the essence of another culture and it?s traditions and, in turn, personally expand your horizons.

3. Your body gets stronger and more balanced in fine ways that many other forms of movement miss.

4. Your mind begins to understand how to be with itself and it?s own thoughts.

5. Works with your bodies energies.

6. Relieves stress

Canada to force striking rail workers back to jobs

TORONTO (AP) ? Canada introduced legislation Monday to force striking Canadian Pacific Railway workers back to their jobs after talks stalled over the weekend, the country's labor minister said Monday.

Labor Minister Lisa Raitt said the freight service shutdown at Canada's second largest railway is hurting the economy.

Locomotive engineers and conductors went on strike Wednesday, shutting down freight service along nearly 14,900 miles (24,000 kilometers) of track in Canada and the U.S.

Raitt called Canadian Pacific Railway the backbone of the country's economy, and she has said she would force strikers back to work if necessary.

"The strike can't go on," Raitt told Parliament. "We need to get the trains running again."

The railway and the union said mediated talks broke off Sunday with little hope of resumption.

The government introduced the back-work-legislation on Monday. Raitt is hoping strikers could be back to work on Thursday.

Raitt noted that Canadian Pacific Railway moves $50 billion worth of freight each year, including more than half of Canada's potash, wheat and coal. The Mining Association of Canada has expressed "grave concern" about the strike's impact.

Prime Minister Stephen Harper's Conservative government has cited potential economic damage in the past for preventing or ending strikes at Air Canada and Canada Post.

Opposition parties said the government is undermining the right to collective bargaining.

Major points of contention in the latest strike are pensions, certain work rules and fatigue management.

The strike has come amid big changes at the railway. Earlier this month, Canadian Pacific appointed an interim chief executive after chief executive Fred Green announced his departure, ending a months-long battle that pitted New York activist investor Bill Ackman against a board of directors stocked with Canadian business titans.

The railroad also elected a new board of 16 directors, including seven backed by Ackman, whose Pershing Square Capital Management fund is Canadian Pacific's largest shareholder with about 14 percent of the company's stock.

Rant Sports MLB Power Rankings For Week Eight

Joy R. Absalon - US Presswire

It is time to continue our?MLB?Power Rankings for the 2012 season, which will continue to focus on the top 10 teams in the majors.

Texas Rangers?(This Week: 1, Last Week: 1) -?The Rangers had struggled to score runs over the past week, but they more than made up for it against the Toronto Blue Jays. Josh Hamilton hit another homer, and the Rangers cruised to a 14-3 victory. Games like these are why the Rangers remain #1 on our MLB Power Rankings.

Los Angeles Dodgers?(This Week: 2, Last Week: 3) -?Matt Kemp and Clayton Kershaw get most of the attention, but how about the season by AJ Ellis? He?s got a 944 OPS with an insane 444 OBP, and he?s transformed himself into one of the best catchers in the game. He won?t keep hitting like this, but Ellis is one of the driving forces behind the Dodgers surprising best record in the majors.

Baltimore Orioles?(This week: 3, Last Week: 4) -?Adam Jones gets his extension and drives in a pair of runs. With Jason Hammel close to free agency he has to be next on the Orioles list. At 29-17, the Orioles are one of the best team in the majors, and remain in the top 3 for our MLB Power Rankings.

Tampa Bay Rays?(This Week: 4, Last Week: 7) -?It?s amazing that they?re a game out of first without Evan Longoria. Alex Cobb has done a fantastic job filling in for the injured Jeff Niemann, winning both of the games he has pitched so far.

Washington Nationals?(This Week: 5, Last Week: 6) -?Their offence is one of the worst in the majors, but at least Bryce Harper is starting to hit again. They took game one of a big series against the Atlanta Braves, who are in a freefall right now.

Atlanta Braves?(This Week: 6, Last Week: 2) -?They got swept by the Reds in a four game series, and now they have to beat Stephen Strasburg in order to stay close to the Nats. Chipper Jones went back on the disabled list, and nothing is going right for the Braves anymore. Given how tight the NL East is, another loss could put them in fourth. A bad week might push them out of the top 10 of our MLB Power Rankings.

Cincinnati Reds?(This week: 7, Last Week: N/A) -?A sweep of the Braves and a surprising lead of the NL Central puts them back on our MLB Power Rankings. They?re winning with good pitching and the continued MVP calibre production of Joey Votto. He?s been one of the best players in the National League, and if the Reds make the playoffs don?t be surprised if Votto takes home his second MVP award.

St. Louis Cardinals?(This Week: 8, Last Week: 5)?-?What a difference a week makes. Last week the Cardinals were unstoppable, and now they trail the Reds by half a game. They got swept by the Dodgers and lost 2/3 to the Philadelphia Phillies. They?ve lost Lance Berkman for another 8-10 weeks, and then they lost his replacement Matt Carpenter. Next week doesn?t get any easier, as they face Atlanta for a 3 game set.

New York Yankees?(This Week: 9, Last Week: 9) -?With the victory last night they?re back in third place in the AL East. Which doesn?t sound very impressive, but right now that?s good enough to be the second wild card team. How about the season by Curtis Granderson? 14 homers, 25 RBI, and a 912 OPS. Everybody talks about the successful seasons of Derek Jeter and Alex Rodriguez, but somehow Granderson always flies under the radar. It?s a shame too, because he?s one of the best players on a loaded Yankees squad.

Cleveland Indians?(This week: 10, Last Week: 10) -?Is it too early to say Shin-Soo Choo is back? With a 900 OPS in May, one of the best all around outfielders in the game is starting to heat up after a forgettable 2011 season. And Cleveland couldn?t be any happier with the timing, as their lead is down to 2.5 games over the Chicago White Sox.

The violence started at 2 p.m. on the MacArthur Causeway off-ramp, just south of the Herald?s offices, the newspaper said.

Witnesses said that a woman saw two men fighting and flagged down a police officer, who came upon the naked man mauling the other man, the Herald reported.

The officer, who was not identified, ordered the naked man to back away, but when the man continued the assault, the officer shot him, the Herald said. Witnesses told the Herald the wounded attacker continued to eat his victim, so the officer continued firing.

Blizzard fixing, updating bedeviled 'Diablo 3'

18 hrs.

The launch of the decade-long-awaited "Diablo 3" has been bedeviled by a variety of issues, but the people behind the action role-playing game?say they have been busy fixing it?and will continue to make more fixes in the coming weeks.

With gamers complaining of being unable to access overloaded servers, of?achievements gone missing and of?gold stolen from hacked accounts, Blizzard has posted a lengthy message to players on its Battle.net forums?explaining that?it has been "working around the clock to address issues as quickly and efficiently as possible."?

Since the game's launch, we?ve applied a number of hotfixes?to address gameplay issues, made tweaks to improve our service stability and performed occasional server maintenance when necessary to ensure that in the long term, players have the best gameplay experience possible.

The message goes on to say that more server maintenance is still required and that Blizzard will be updating the game with a patch?"sometime next week" to address additional issues and bugs.

While Blizzard says it is still trying to figure out how to address the issue of achievements that went missing as gamers played?during the first days after launch, it doesn't sound like there's much to be done about the hacked accounts.

Despite some players speculating otherwise,?Blizzard insists that its servers have not been compromised and says that the number of players reporting hacked accounts is "extremely small." The company goes on to explain:

?In all of the individual Diablo III-related compromise cases we've investigated, none have occurred after a physical Battle.net Authenticator or Battle.net Mobile Authenticator app was attached to the player's account, and we have yet to find any situation where a Diablo III player's account was accessed outside of "traditional" compromise methods (i.e. someone logging using an account's login email and password) ...?

The best defense against account theft still includes smart password management (e.g. using a unique password for every site/service and keeping your password to yourself) and scanning for malware and viruses regularly, as well as following additional preventative steps found here.?

And in a final bit of news, Blizzard said that it has pushed back the launch of its?real-money auction house?(a place gamers will be able to use real money to to buy and sell virtual "Diablo 3" items) indefinitely.?

All of the troubles aside, "Diablo 3" is still?selling at a record-breaking pace. And the game continues to rake in high marks from reviewers. Here's what our own In-Game editor Todd Kenreck thought about it:

Male fertility genes discovered

Friday, May 25, 2012

A new study has revealed previously undiscovered genetic variants that influence fertility in men. The findings, published by Cell Press on May 24th in the American Journal of Human Genetics, shed much-needed light on human reproduction and might provide answers for countless men suffering from infertility.

Despite its high incidence, infertility remains a sensitive topic. Some of the stigma surrounding infertility arises from a lack of known scientific causes. In fact, nearly a quarter of reported infertility cases remain unexplained. Research regarding the genetics of fertility has come primarily from studies involving infertile subjects. "Such studies have not been able to identify genes or pathways contributing to variation in natural human fertility," remarks Carole Ober, the lead author of the study. This is because numerous non-genetic factors, such as alcohol and tobacco use, certain medications, and disease history, can contribute to infertility.

Ober and her graduate student, G?l?m Kosova, at the University of Chicago have taken a different approach. By studying a founder population, the Hutterites, Ober's research maximizes genetic influences and minimizes non-genetic ones. The Hutterites are a branch of Anabaptists who conscribe to a common set of religious and social beliefs. "Hutterites [forbid] contraception and uniformly desire large families, providing an outstanding population in which to study the genetics of normal human fertility," explains Ober. Rather than studying infertile subjects, the team included Hutterite men who had one or more child, and it took both family size and birth rate into consideration.

The study uncovered more than 40 genetic regions that influence fertility in Hutterite men. Nine of these regions were additionally found to impact sperm quality in non-Hutterites. These regions harbor genes involved in several essential biological processes, including protein regulation, nucleotide binding, and immunity, and shed light on the complexity of human fertility. Ultimately, says Ober, further studies might find that mutations in these genes underlie some of the currently unexplained cases of male infertility.

(AP) ? A forensic scientist testified Friday that two cotton balls and a syringe needle allegedly saved after a steroids injection tested positive for Roger Clemens' DNA, a key moment as the government tries to prove the former pitcher used performance-enhancing drugs.

Alan Keel told jurors that the DNA on both cotton ball matches were "unique to one person who has ever lived on the planet" ? Clemens. He said that one of the cotton balls had a random match possibility of one in 15.4 trillion for Clemens' DNA, and the other had one in 173 trillion, when comparing to the population of white people in the U.S.

The needle was not as conclusive, because Keel was only able to get a handful of cells. That match was one in 449.

Brian McNamee, Clemens' former strength coach, earlier testified he collected the medical waste after injecting the pitcher with steroids in 2001, and turned them over to federal authorities in 2008. Earlier government witnesses testified that steroids were found on the medical waste.

Clemens is accused of lying to Congress in 2008 when he denied using performance-enhancing drugs.

Prosecutors hope that Clemens' DNA ? which helped make him one of the most successful pitchers in baseball history ? will help them convict him of a federal crime.

While Keel's testimony was a milestone moment for the government, the defense indicated early on it wouldn't contest that the needle had both steroids and Clemens' DNA on it. But Clemens' lawyer Rusty Hardin said in his opening statement that the defense will contend that McNamee put the steroids in the needle after injecting Clemens and that the coach in fact had used the needle to inject Clemens with vitamin B12. Clemens has maintained for years that he received B12 shots and the local anesthetic lidocaine but not performance-enhancing drugs.

Prosecutor Courtney Saleski tried to pre-empt that by asking Keel if there was any way to "fake this."

Keel said no.

"If this were contrived, I would expect to obtain much more biological material," he said ? in other words, it would be hard to fake a sample with such a small amount of biological material on it.

The gauze pad, meanwhile, matched McNamee's DNA, to an even greater probability than Clemens did for the cotton balls. Keel said that the match was 1 in 1.8 quintillion people for white Americans. A quintillion has 18 zeroes in it.

During cross-examination, Clemens lawyer Michael Attanasio tried to suggest the possibility of contamination in the items McNamee saved.

But Keel said that if there were contamination, he would have expected to find McNamee's DNA on the needle. But he found only found Clemens'.

Attanasio suspended his cross-examination for the lunch break and planned to finish it Friday afternoon.

Also Friday, U.S. District Judge Reggie Walton said he would have a hearing on Monday, June 4, to discuss the defense subpoena for the testimony of Rep. Darrell Issa, chairman of the House Oversight and Government Reform Committee. That committee held the congressional hearing that Clemens testified before in 2008. Issa, a California Republican, was not chairman at the time, but he participated in the congressional deposition of Clemens and criticized the panel, then run by Democrats, for having the hearing on steroids in baseball.

Issa and the committee have filed a motion to quash subpoenas for the congressman and for committee documents. They argue the subpoenas are barred by the Constitution's speech or debate clause, which protects elected officials from being questioned in a lawsuit about their legislative work.

How to Handle Auto Repair Issues in Atlanta to Get Quality Service

9:18 am ultimate hobbies

Looking for quality auto repair atlanta has to offer? Why stress yourself just to find one? The city of Atlanta holds quite a huge population of drivers, which means more cars and more auto repair shops offering standard to high quality auto care services. Before driving to the car shop of your choice though, we recommended you to do a few things first such as: Check your car personally to have something to tell the car mechanic when you reach the place. It?s like checking for injuries during emergency response so that you have accurate information to present when doctor arrives to take over.

From your testimony, the car mechanic will then draw initial assessment. He would know which area to look first. You should be prepared to report the common problems that your car encounters. In case the car has no visible damage that needs immediate action, the car mechanic should know whether you like a tune up or parts replacement.

These are basic questions often asked when visiting an auto repair shop in Atlanta. Lesson learned? If you want to get quality service, give quality information. Remember it is your car for which you want just the best.

Three Falcons Recognized By College Sports Madness

College Sports Madness has announced their picks for all-Mid American Conference first and second teams, and three Falcons have been selected on the second team. Andrew Kubuski (OF), T.J. Losby (C), and Brian Bien (IF) were all selected. The three players led the Falcons offensively and defensively this season, as they held the top three batting averages as the season came to a close last week.

Kubuski, a native of Elyria, Ohio, batted .367 on the season to lead the Falcons. He also led the Falcons in at-bats (196), runs (29), hits (72), total bases (88), and outfield assists (6). Kubuski batted .343 in conference play, playing in all 27 games.

Losby was recognized as the second team catcher, batting .319 during 2012. Starting the majority of the games behind home plate, Losby was the only Falcon to appear in all 53 games this season. Losby led the Falcons in RBI with 37, while slugging .440 on the year.

Bien, who was named to the second team all-MAC yesterday, garners his second all-conference award after an impressive freshman season which saw him hi .345. Bien led the Falcons in average during MAC play, hitting at a clip of .357. After being inserted into the lineup as the primary second baseman, Bien made just four errors in the last 24 games of the season.

All three Falcons will return next season, along with nine other position player teammates who saw action in at least 30 games during 2012.

Staff bled $44M from heiress Clark, suit says

W.A. Clark Memorial Library

Huguette Clark with one of her dolls.

NEW YORK ? The nurses, doctors, hospital, attorney and accountant for the reclusive heiress Huguette Clark coerced or influenced her to give them more than $44 million in gifts, the executor of her estate claimed in a remarkable legal petition filed Tuesday in Manhattan. The executor asked the court to order all the money to be repaid.

The executor doesn't deny that Clark authorized nearly all of these gifts, relentlessly writing hundreds of checks in her own steady hand until her eyesight gave out at the age of?102.

The accusations were vigorously denied by Clark's attorney, whose representative said, "To suggest that these gifts were not from Mrs. Clark's generous heart is to denigrate the person who gave these gifts,?as well as the?recipients who cared for her with their love."

The most-favored object of Clark's generosity was her registered nurse, Hadassah Peri, an immigrant from the Philippines who had been randomly assigned in 1991 by a home healthcare agency. For 20 years Peri was the daytime private nurse, working 12-hour shifts, five or six days a week, taking care of Clark's health, her hygiene and her purchases of dolls at auctions. She was paid at an annual salary of $131,040. In addition, she and her family received $31 million in gifts, including the money to buy five homes, jewelry, dolls and a Stradivarius violin (though not Clark's best Stradivarius).

Another $6.3 million, including a $6 million painting by Manet, was given to Beth Israel Medical Center, which allowed Clark to live in the hospital although she was quite healthy for most of her last two decades.

Clark's two physicians and their families received gifts of $3.1 million.

The night nurse and her family got $1.1 million.

The accountant, $375,000.

The attorney, just $60,000 ? in addition to $1,850,000 given after the terror attacks of Sept. 11, 2001, for a security system for the attorney's daughter's Israeli community on the West Bank.

All of these amounts were gifts on top of salaries.

If the judge in Surrogate's Court agrees with the executor, all will?have to?be repaid.

The legal petition filed late Tuesday afternoon, available here from msnbc.com, is an attempt to claw back into the estate millions that the executor claims was bled away by undue influence or fraud. Two other petitions are expected to be filed Wednesday by the executor, to beat the deadline of a year since Clark's death. Those petitions are expected to accuse Clark's attorney and accountant of malpractice and breaches of fiduciary duty, possibly opening the door for some of the claims to be covered by professional liability insurance policies.

Should they have to give back the gifts?

Huguette (pronounced "hue-GET") Marcelle Clark, born in Paris in 1906, inherited her fortune from William A. Clark, a U.S. senator from Montana who was among the richest men of the Gilded Age, a copper miner, a banker, a builder of railroads, and founder of the city of Las Vegas.

His youngest daughter attracted the attention of msnbc.com in 2009 because of her vacant but well-manicured mansions and questions about the management of her money. She lived her last 20 years in spartan hospital rooms in New York City, dying in May 2011 just weeks before her 105th birthday. (The archive of Clark stories, photos and videos is at http://clark.msnbc.com/.)

'Virtually no visitors'
The executor's petition draws a picture of a woman isolated and controlled by others from 1991, when she was admitted to Doctors Hospital, until 2011, when she died at Beth Israel Medical Center, One of her former attorneys represented her for 20 years without meeting her face to face, instead talking to her on the phone and through a closed door.

"Mrs. Clark had virtually no visitors other than persons who were on her payroll," wrote Peter S. Schram, outside counsel for the Public Administrator of New York County. That official, Ethel J. Griffin, was appointed by the court as the temporary executor of the Clark estate after questions were raised about the actions of Clark's attorney and accountant, whom Clark had named as executors.

"Mrs. Clark," Schram wrote, "was completely dependent for her physical and emotional needs on a small group of individuals, who were her only contacts with the world outside of her hospital room."

The executor claims that this close circle of caregivers exerted undue influence and control over Clark, making her unable to make free and intelligent decisions. The executor claims that the attorney and accountant never fully informed Clark of the tax ramifications of her gift-giving. The executor also says that Clark suffered from various unspecified "physical and mental infirmities," and by 2009, at age 102, she was suffering from severe loss of sight and hearing along with episodes of "hallucinations and confusion."

Those claims will be countered by documents showing that Clark, while a recluse who saw few visitors, was never diagnosed with any mental illness, paid close attention to her financial affairs through the years, and rebuffed or ignored the advice of attorneys and accountants, even as they warned her that the gifts were making her cash poor, running up a tab of millions in unpaid gift taxes.

The petition's claims were rejected by Clark's attorney, Wallace Bock, whose own attorney issued a statement.

The filing by the executor "reflects a total disloyalty and lack of fiduciary care to Mrs. Clark," attorney John D. Dadakis of the firm of Holland & Knight said in a written statement to msnbc.com. "Our client, Wallace Bock, has honored Mrs. Clark's wishes during his career and handled her affairs with the utmost duty of loyalty to her. Mrs. Clark understood each and every gift she made, and they were made with the love that she had for those who were close to her.

"To suggest that these gifts were not from Mrs. Clark's generous heart is to denigrate the person who gave these gifts,?as well as the?recipients who cared for her with their love," Dadakis wrote. "All of the records reflect that Mrs. Clark actively enjoyed her generosity and fully understood what she was giving. Mr. Bock will vigorously defend the acts of Mrs. Clark and we fully expect that the record will prove that all the gifts of Mrs. Clark were made by her, being fully aware of what she was doing."

Hadassah Peri has not spoken publicly about Clark, but a press agent issued a statement on her behalf in June after she was named in the will: "I saw Madame Clark virtually every day for the 20 years. I was her private duty nurse but also her close friend. I knew her as a kind and generous person, with whom I shared many wonderful moments and whom I loved very much. I am profoundly sad at her passing, awed at the generosity she has shown me and my family, and eternally grateful. Just as Madame Clark demonstrated kindness toward others in her actions, so, too, will I and my family devote a substantial portion of this bequest toward making the world a better place for all people."

All the parties named in the court papers have until Aug. 8 to respond in Surrogate's Court.

The gifts claimed by the executor as not valid include the following:

 • $17,117,326.03 given by Clark to the nurse, Peri, in more than 200 personal checks written by Clark from 1991 to 2001.
 • $5 million paid to Peri, funded by a line of credit from JPMorgan because Clark had insufficient liquid assets. The executor acknowledges that the attorney, Bock, had a signed authorization from Clark for this payment and nearly all the others listed here, and by 2009 she had signed over to him a document called a durable power of attorney, giving him authority over certain financial affairs.
 • $3,883,685.78 given to Peri to purchase five homes: a co-op apartment on the Upper West Side of Manhattan, two condos on the Upper East Side, a house in the borough of Brooklyn, and a vacation home in Ocean, N.J., as disclosed by msnbc.com in 2010.
 • $1,935,200 in other tangible gifts to Peri, including 84 pieces of jewelry worth $667,300, a doll worth $64,400; a Stradivarius violin worth $1.2 million (not Clark's $6 million Strad, which was sold); and three harpsichords worth $3,500.
 • $60,000 in a check written by Clark's attorney in 2009 to Peri.
 • $3.4 million to Peri's family, including $1,503,813 to her husband, Daniel Peri, $706,550 to her son David, $628,250 to her son Abraham, and $632,450 to her daughter, Guela.
 • $685,000 given to Clark's licensed practical nurse on the night shift, Geraldine Coffey, who also worked from 1991 to 2011 at an annual salary of $131,040.
 • $358,327 to help Coffey buy two condo apartments on the Upper East Side.
 • $85,554 for tuition of Coffey's children.
 • $30,000 given to Coffey by the attorney.
 • $10,000 given to Erlinda Ysit, a licensed practical nurse for Clark for seven years.
 • $6 million Manet painting sold to benefit Beth Israel Medical Center, which allowed Clark to live in the hospital, even though for most of her two-decade stay "there was no medical need." This gift, and $295,000 in other gifts, was made on top of the $300,000 to $400,000 a year she paid to the hospital to live there. "At no time did Beth Israel, its staff, or any other physician or expert conduct a neurological examination or psychological examination of Mrs. Clark or otherwise ensure that she possessed the capacity required to make a gift to Beth Israel," Schram wrote.
 • $500,000 given to the Corcoran Gallery of Art in Washington, D.C. The executor did not yet ask for this money to be returned, but asked for the court to order an inquiry.
 • $1,168,000 given to Dr. Jack Rudick, one of her physicians, and his wife, Irene Rudick.
 • $1 million lent by Clark to Dr. Rudick, on which he made no payments, and which she forgave.
 • $667,951 given to Dr. Henry Singman, her primary treating physician for 20 years.
 • $33,857 paid by attorney Bock to cover Singman's professional liability insurance premiums. (Not authorized in writing by Clark, the executor said.)
 • $200,000 paid to Singman's family.
 • $1,850,000 paid to an Israeli community on the West Bank where the family of attorney Bock lives. Documents show that Bock asked Clark in 2000 if she wanted to contribute to a security system. The total amount to be raised was $1,850,000, and Clark wrote in that amount, agreeing to pay the entire cost. Only five days earlier, according to the court records, Bock and accountant Irving Kamsler had written letters to Clark, warning that her gifts were out of hand, that she would owe $12.5 million in gift taxes, and that she might have to sell assets to raise cash. The executor accuses Bock of failing to remind her, when he solicited the gift benefitting his family, of this earlier warning about her financial situation, as well as failing to advise her of the right to seek independent counsel, nor arranging a medical evaluation to confirm that she had sufficient capacity to make the gift.
 • A $60,000 check written by Bock to himself in December 2009. Bock testified at his deposition in March that this check was authorized by a letter signed by Clark a month earlier. That letter was prepared by Bock, who gave $48,000 of the gift to his law firm, in line with his partnership agreement. The executor wants that money back as well, claiming that Clark never intended to make any gift to Collier, Halpern, Newberg, Nolletti & Bock.
 • $375,000 in checks written by Clark to Kamsler, a felon and registered sex offender, from 2000 to 2008, on top of his monthly salary, and a $60,000 check written by Bock to Kamsler in 2009, authorized by a letter from Clark. (Bock at the same time wrote checks to nurses, doctors and others, mostly in line with payments that she had made previously.)

Other gifts are not being challenged by the executor. For example, Clark gave $10 million in 2000 to her friend Suzanne Pierre, now deceased, but Pierre might not be considered to have a confidential or fiduciary relationship with Clark.

Criminal investigation
Originally the executors of the Clark estate were Clark's attorney and accountant, but the court revoked the accountant's authority, and suspended the attorney from his role, leaving only the public official to manage the estate. The judge, Surrogate Kristin Booth Glen, acted after the public administrator's attorney revealed that Kamsler failed to file gift tax returns from 1997 through 2003, and falsely claimed on later returns that all taxes had been paid, leaving Clark owing millions in gift taxes plus interest and possible penalties. (See the earlier story.)

Though a criminal investigation was launched in August 2010 into the handling of Clark's finances by Bock and Kamsler, no one has been charged. Both men have maintained that they did nothing more than carry out the wishes of a woman who wanted to protect her privacy. The investigation continues by the Elder Abuse Unit of the New York County District Attorney's Office. The investigation was prompted in part by reports at msnbc.com about the sale of property owned by Clark, including a Stradivarius violin and a Renoir painting.

To direct her $400 million fortune, at age 98 the heiress signed two wills.

The first will favored the relatives from her father's first marriage. They were not named: The will left the money to the "intestate distributees," legal language for the people who would inherit her money if she died without a will. (Clark had been married only briefly, and had no children.) And the will gave $5 million to the nurse, Peri.

Just six weeks passed before she signed a new will, cutting out the family, which claims that this will was the product of fraud. The new document? leaves the largest share of her money to a museum for her art collection in her oceanfront estate in Santa Barbara, Calif. Millions more (an estimated $27 million after taxes) and a doll collection will go to Peri, and lesser amounts to a godchild, the hospital, and doctor, as well as $500,000 each to the attorney and accountant. (See the earlier story and read the documents: A twist: Heiress Huguette Clark signed two wills.)

The $400 million heavyweight battle over the wills is about to begin, with the $44 million in gifts providing the preliminary bout.

Clark's jewelry collection sold in April for $18.3 million. That money will be held by the estate during the contest over the wills. Her three apartments overlooking Central Park and Fifth Avenue, a total of 15,000 square feet, are on the market for $55 million; one of the three has found a buyer. Her country estate in New Canaan, Conn., is for sale for $17 million. Her $100 million estate in Santa Barbara, which the Clarks had not visited for half a century, is being carefully maintained, awaiting the court's decision on the will's plan for an art museum.

A twist: If the executor is successful in recovering for the estate millions from the nurse, doctor, hospital, attorney and accountant, and if the second of Clark's written wills is the one to be upheld, those same millions can then be paid out to the beneficiaries, including the nurse, doctor, hospital, attorney and accountant.
